These Terms of Service govern your access to and use of BlueServ's customer communication, scheduling, analytics, and automation tools.
1. Acceptance of Terms
By accessing or using BlueServ, you agree to these Terms of Service. If you do not agree to these Terms, you should not use the service.
2. Services Provided
BlueServ provides customer communication, appointment scheduling, call summaries, analytics, notifications, and related business automation tools for home-service businesses. Features may include AI-assisted call handling, calendar scheduling, customer follow-up tools, owner notifications, and performance reporting.
3. Customer Responsibilities
Customers are responsible for providing accurate business information, maintaining authorized access to connected services, reviewing appointments and communications generated through BlueServ, and complying with applicable laws, regulations, and industry requirements.
Customers are also responsible for ensuring that their use of BlueServ is appropriate for their business operations and that any information provided to customers, employees, contractors, or end users is accurate and up to date.
4. Third-Party Services
BlueServ may integrate with third-party services, including Google Calendar, Twilio, Retell AI, email providers, hosting providers, and other service providers. BlueServ is not responsible for outages, interruptions, delays, errors, data loss, policy changes, pricing changes, or limitations caused by third-party platforms.
5. AI-Assisted Communications
BlueServ may use automated or AI-assisted systems to help answer calls, collect customer information, summarize conversations, identify appointment requests, and support scheduling workflows. Customers acknowledge that automated systems may occasionally produce incomplete, inaccurate, delayed, or misunderstood information.
Customers should review important appointments, emergency requests, customer communications, and business-critical information before relying on them.
6. Calendar and Scheduling
BlueServ may connect to calendar services to check availability, create appointments, and support scheduling workflows. Customers are responsible for verifying calendar accuracy, technician availability, business hours, service areas, emergency handling rules, and appointment details.
7. Messaging and Notifications
BlueServ may send email or SMS notifications related to appointments, customer inquiries, missed-call follow-up, recall requests, emergency requests, after-hours requests, scheduling updates, and account activity.
By providing a phone number during a service request, appointment request, or customer inquiry, you agree that BlueServ or the business using BlueServ may send service-related text messages about that request. Message and data rates may apply. Message frequency may vary.
You may opt out of SMS messages at any time by replying STOP. You may request assistance by replying HELP.
BlueServ does not sell mobile phone numbers or SMS consent information. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
Customers are responsible for ensuring that their use of messaging features complies with applicable communication, consent, privacy, and anti-spam laws.
8. Acceptable Use
You may not use BlueServ to:
- Violate any law, regulation, or third-party right
- Transmit fraudulent, deceptive, abusive, harmful, or unlawful content
- Attempt to gain unauthorized access to BlueServ or connected systems
- Interfere with, disrupt, overload, or damage the service
- Use the service for spam, harassment, or unauthorized messaging
- Reverse engineer, copy, resell, or misuse the platform without permission
9. Fees and Payment
Subscription fees, setup fees, and usage-based charges, when applicable, are due according to the selected plan or agreement. Failure to pay required fees may result in suspension, limitation, or termination of service.
Pricing, plan features, billing terms, and usage limits may change over time. Any specific commercial terms agreed separately with a customer will control where applicable.
10. Service Availability
While BlueServ strives to provide reliable service, we do not guarantee uninterrupted, secure, or error-free operation. The service may be unavailable due to maintenance, updates, third-party outages, internet issues, security events, or other circumstances beyond our control.
11. Data and Privacy
BlueServ's collection and use of information is described in our Privacy Policy. Data deletion requests are described in our Data Deletion Policy.
12. Suspension and Termination
We may suspend or terminate access to BlueServ if a customer violates these Terms, misuses the service, fails to pay required fees, creates security or compliance risk, or uses the service in a way that may harm BlueServ, customers, third parties, or connected platforms.
Customers may discontinue use of BlueServ at any time, subject to any applicable billing terms, service agreements, or outstanding obligations.
13. Disclaimers
BlueServ is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.
14. Limitation of Liability
To the maximum extent permitted by law, BlueServ shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, data loss, service interruption, or reputational harm arising from or related to use of the service.
15. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised "Last Updated" date. Continued use of BlueServ after updates are posted means you accept the updated Terms.
